Chapel Loyalty Program Policy

Effective June 1, 2021Precious Moments Foundation, including Precious Moments Chapel Gift Shoppe (“PMF”, “Foundation”, “we”, “us”, “our”) values our Customers’ support and devotion to the PRECIOUS MOMENTS® and NE’QWA ART® brands, merchandise, and services. The loyalty program for merchandise purchased through Precious Moments Foundation, including orders placed in-person, online, via phone, or via email to Precious Moments Chapel Gift Shoppe is the “Chapel Loyalty Program”, herein referred to as “Chapel Loyalty Program” or “Program”. Chapel Loyalty Program operates under the terms and conditions set forth herein (“Program Terms”), and the published Legal Terms & Conditions to which it is annexed, unless expressly stated herein. The Program Terms outlined herein govern the Foundation’s relationship and expectations to users of the Chapel Loyalty Program (collectively “Customers”, “Participants”, “you”, or “your”), including how Customers earn, manage, and redeem rewards (herein after referred to as “Stickers” or “Rewards”) through qualifying actions.

1.             Customer Acknowledgement.

By accepting a Chapel Loyalty Program Card (“Program Card”) to earn and redeem Rewards through the Program, and your continued participation in the Program, you agree that: (i) you have read, understand, and agree to abide by these Program Terms, including any subsequent changes to these Program Terms, which when made effective are incorporated into these Program Terms; and (ii) you consent to the collection, use, and disclosure of certain personal data by the Foundation and any authorized third-party service providers in accordance with the Foundation’s published Privacy Policy .

2.             Eligibility.

a.  Participation Requirements. Chapel Loyalty Program is open to all individuals age eighteen (18) years or older who: (i) has not previously been terminated, restricted, and/or prohibited from Chapel Loyalty Program; (ii) is a Customer in good-standing with the Foundation; (iii) resides in a jurisdiction which legally permits participation in a loyalty program.

b.  Participation Obligations. Participant must meet minimum Participation Requirements in order to earn Stickers and redeem eligible Rewards.

c.  Participation Fees. Chapel Loyalty Program is free to join and participate. There are no membership fees or minimum balance requirements to participate in Chapel Loyalty Program.

d.  Location. Chapel Loyalty Program is only available for qualifying PRECIOUS MOMENTS® and NE’QWA ART® merchandise purchased through Precious Moments Chapel Gift Shoppe transactions, including purchases made in-person (4321 Chapel Road, Carthage, Missouri 64836), online (www.PreciousMomentsChapel.org), via phone, or via email to Precious Moments Chapel Gift Shoppe.

3.            Eligible Purchases and Earning Stickers, Ineligible Purchases.

a.  Eligible Purchases. Stickers are accrued on the order whole dollar subtotal in U.S. currency (USD). Stickers are accrued at a rate of one (1) Sticker per thirty-five U.S. dollars (USD 35.00) spent on eligible purchases. Accrued Stickers have no cash value and cannot be redeemed for cash or store credit. All PRECIOUS MOMENTS® and NE’QWA ART® merchandise are eligible to earn Stickers.

b.  Ineligible Purchases. Stickers are not accrued on Event Registrations, Event Exclusive merchandise, Engraved Brick Program purchases, or other donation or Support the Foundation program purchases. Taxes, shipping and handling, customs/import duties, or similar processing charges do not earn Stickers.

4.            Redemption.

a.  Value. Stickers can be redeemed for discounts on qualifying purchases at the rate of nine (9) Stickers equals thirty-five U.S. dollars (USD 35.00) discount. Stickers cannot be redeemed in combination with other discounts, offers, or promotions. Foundation reserves the right to limit maximum discounts and redemption period.

b.  Qualifying Purchases. Stickers are not redeemable for transfer or merchandise purchased from previous purchases, discount programs (including but not limited to Warehouse Sales, Grab Bags, or Clearance Sales), Event registrations (including but not limited to Family Reunion Event Packets), Event Exclusive merchandise, Engraved Brick Program purchases, or other donation or Support The Foundation program purchases, taxes, customs/import duties, shipping and handling, or similar processing charges, cash, store credit, or gift cards.

c.  Location. Chapel Loyalty Program is only available for PRECIOUS MOMENTS® and NE’QWA ART® merchandise purchased through Precious Moments Foundation, including orders placed in-person, online, via phone, or via email to Precious Moments Chapel Gift Shoppe.

d.  Process. Customer must surrender their original qualifying Program Card to redeem Stickers at the time of purchase. Customer must mail to Precious Moments Chapel Gift Shoppe all original qualifying Program Cards to redeem Rewards for orders placed online or via phone or email. Multiple Rewards can be redeemed to maximize purchase discount, however, discounts exceeding the subtotal purchase amount will be forfeited by the Customer. Foundation reserves the right to limit maximum discounts and redemption period.

5.          Program Maintenance.

a.  Program Card. Foundation is not responsible for lost, stolen, destroyed or misplaced Program Cards. Program Cards and/or Stickers cannot be duplicated or replaced. Foundation does not maintain records of Program Cards or Stickers accrued or redeemed.

b.  Customer Termination. Foundation reserves the right to suspend, restrict, or terminate Customer access to the Program in the event Foundation believes Customer has: (i) acted in a manner inconsistent with applicable laws, regulations, or ordinances; (ii) failed to complete a transaction due to insufficient or fraudulent funds; (iii) breached or violated any of these Program Terms or the Legal Terms and Conditions; (iv) fraudulently claimed or redeemed Stickers; (v) attempted to transfer, sell, or barter Stickers; or (vi) fraudulently duplicated or manipulated a Program Card or Stickers, or otherwise attempted to defraud the Foundation.

In the event of Customer Termination: (i) Customer waives any claim or right to redeem eligible Rewards for merchandise, cash, credit, or other interest; (ii) Foundation has no obligation to Customer and will not compensate or otherwise reimburse Customer for eligible Rewards unclaimed at the time of termination. Customers choosing to cancel their participation in the Program can abandon their Program Card at any time.

c.  Program Termination. Foundation reserves the right to terminate the Program, wholly or in part, at any time. In the event Foundation wholly terminates the Program, Foundation shall endeavor to notify Customers at least thirty (30) days prior to termination date by, minimally, a mailing sent to subscribed Customers’ email address and a public notice on the Foundation’s website (www.PreciousMomentsChapel.org). Customers shall be afforded not less than thirty (30) days from the notice date to redeem eligible Rewards. Customer shall forfeit any unclaimed Reward upon the Program termination date. Unless otherwise stated in the termination notice, all Program Terms apply.

d.  Redemption Period. Program Cards and Stickers do not expire. Foundation reserves the right to modify the terms of the Program, including but not strictly limited to: redemption or accrual value, qualifying purchases, process, and expiration dates at any time during the Program, without advance notice to any Customer.

e.  Returned Merchandise. In the event Customer returns any merchandise under the terms of the published Limited Warranty Policy , Customer must forfeit all Stickers accrued as a result of the original purchase.

6.          Additional Program Terms.

a.  Limitation of Liability. Foundation is not responsible or liable to any Customer for: (i) any loss, misdirection of, or delay in accrual of Stickers, Rewards, or Program notification, update, or modification; (ii) any errors published in relation to the Program or merchandise, including but not strictly limited to: availability, pricing errors, typographical errors, errors of description, system/operational errors whether temporary or persistent; (iii) any loss or damage to Program Cards or Stickers; or (iv) Customer’s manipulation to, theft of, fraudulent earning of, or unauthorized redemption of Stickers, Rewards, or Program Cards. IN NO EVENT WILL PRECIOUS MOMENTS FOUNDATION OR ITS OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE CHAPEL LOYALTY PROGRAM, THESE PROGRAM TERMS, THE FOUNDATION’S PRIVACY POLICY, THE FOUNDATION’S LEGAL TERMS & CONDITIONS OR THE FOUNDATION’S OPERATION OF THE PROGRAM.

b.  Interpretation. The interpretation of these Program Terms are at the sole discretion and decision of the Foundation. All decisions made by Foundation are final. In the event of any discrepancy between the English version and any translated version of these Program Terms, the English language version will govern.

c.  Waiver of Liability. Foundation’s waiver of any breach of these Program Terms by any Customer does not constitute a waiver of any prior or subsequent breach of these Program Terms. Foundation’s failure to act upon a breach of these Program Terms by any Customer will not be deemed as a waiver of any rights or remedies the Foundation may have against that or any other Customer. Foundation may, from time to time at its sole discretion, waive certain Program Terms in conjunction with a promotion or offer to provide Customers with enhanced benefits, options, or Rewards.

d.  No Warranties or Representation. Foundation makes no warranties or representations, either expressed or implied, with respect to availability, type, quality, or fitness of goods or services provided through the Program.

e.  Governing Law. These Program Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without giving effect to the principles of conflict of law and the courts within Missouri will be the only courts of competent jurisdiction.
